Communications Consent & SMS Marketing Terms

By providing your express written consent, you agree to receive recurring marketing and informational telephone calls, text messages (SMS and MMS), and emails from TAG at the telephone number and email address you provide.
These communications may be delivered using automated telephone dialing systems, automated messaging technology, artificial or prerecorded voice messages, and other electronic communication methods.
Consent is not a condition of purchasing any product or service. You are not required to agree to receive marketing communications to obtain information about or purchase TAG's services.
Messaging Frequency & Charges Message frequency varies depending on your interactions with TAG, your requests for information, and ongoing communications regarding our services.
Message and data rates may apply. Please contact your wireless service provider regarding applicable messaging or data charges.
TAG reserves the right to adjust message frequency and to communicate from different authorized business telephone numbers. Communications will identify TAG as the sender when appropriate.

Dispute Resolution & Binding Arbitration
1. Agreement to Arbitrate
In the interest of resolving disputes between you and TimeShare Advocacy Group (TAG) in an efficient and cost-effective manner, you and TAG agree that, to the extent permitted by applicable law, any dispute arising out of or relating to these Messaging Terms and Conditions, or your receipt of text messages from TAG or its authorized service providers, will be resolved through binding arbitration.
Arbitration is generally less formal than traditional court proceedings. It involves a neutral arbitrator rather than a judge or jury, may provide more limited opportunities for discovery, and is subject to limited judicial review. An arbitrator may award the same damages and remedies available in a court of competent jurisdiction, subject to applicable law.
This agreement to arbitrate includes claims arising under contract, tort, statute, fraud, misrepresentation, or any other applicable legal theory, regardless of when the claim arises, to the extent such claims may lawfully be subject to arbitration.
BY AGREEING TO THESE MESSAGING TERMS AND CONDITIONS, YOU AND TIMESHARE ADVOCACY GROUP ACKNOWLEDGE THAT YOU ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION, TO THE EXTENT PERMITTED BY LAW.
This arbitration agreement shall be governed by the Federal Arbitration Act (FAA), where applicable.
2. Exceptions to Arbitration
Notwithstanding the arbitration requirements described above, nothing in these Messaging Terms and Conditions shall prevent or otherwise limit either you or TAG from:
Bringing an individual claim in small claims court, provided the claim qualifies for that court's jurisdiction.
Filing a complaint or pursuing an enforcement action with an applicable federal, state, or local regulatory agency, where permitted by law.
Seeking temporary or preliminary injunctive relief from a court of competent jurisdiction in support of arbitration.
Filing a lawsuit in a court of competent jurisdiction involving claims of intellectual property infringement.
Nothing in this agreement shall restrict any rights or remedies that cannot lawfully be waived under applicable consumer protection laws.
3. Arbitration Procedures & Notice of Dispute
Any arbitration between you and TimeShare Advocacy Group (TAG) shall be governed by the Federal Arbitration Act, where applicable, and administered by the American Arbitration Association (AAA) in accordance with its applicable Consumer Arbitration Rules, as modified by these Messaging Terms and Conditions to the extent permitted by law.
Information regarding AAA arbitration procedures, applicable rules, and filing requirements is available at:https://www.adr.org

The Notice of Dispute must include:
A description of the nature and factual basis of the claim or dispute.
A statement identifying the specific relief, remedy, or resolution being requested.
Both parties agree to make reasonable, good-faith efforts to resolve the dispute informally before proceeding with arbitration.
If the parties are unable to reach a mutually acceptable resolution within 30 calendar days following receipt of the Notice of Dispute, either party may initiate arbitration in accordance with the applicable AAA rules and procedures.
Nothing in these provisions shall prevent either party from exercising rights that cannot legally be restricted or waived under applicable federal or state law.
